An autographic will is the will written entirely in the handwriting of the testator, dated and signed by him.

The autographic will may be filed with a notary public for safeguarding. The notary public prepares an act of deposit of the will and keeps the file to his registry. At the same time, informs the competent Section of Wills of the Court of First Instance for the deposit in his registry of the above mentioned will.

Following the death of the testator it is required that it is declared as master will and published by the competent court.


In case the autographic will has been deposited to a notary public, the publication of the will at the comptetent Court of First Instance will be carried out with the concern of the notary.

While the authographic will is kept by the heirs themselves, it has to be published with their own concern and the assistance of lawyer.
